PRODUCT WARRANTY: Nightlife Supplies USA offers a 30 warranty against any manufacturer defect only. If the product stops working for the reasons of misuse, mistreated, dropped, wet, placed in a room that releases heavy moisture, moisture build up which can cause a short circuit, rain, or simply used irresponsibly. That is considered a damaged product, not a manufacturer defect. In that case the warranty will be void. Please refer to our return policy.

Additional Terms and Conditions -- Disclaimer

All prices quoted are cash prices and are quoted FOB to the nearest Distribution Center stocking product. Prices, terms, and specifications are subject to change by Nightlife Supplies USA DBA without notice. Payment is due in full upon delivery of the order to the purchaser. Should purchaser fail for any reason to make payment in full, the outstanding unpaid balance shall bear interest at the rate of 18% per annum until paid in full. Should purchaser fail to make payment for its order upon delivery, refuse delivery, or otherwise breach the terms of this agreement, Nightlife Supplies USA DBA shall be entitled to recover both actual damages, interest, consequential damages and all costs and expenses including collection fees, court costs, and attorney’s fees. Nightlife Supplies USA will not in any circumstance be liable for any Customs, or import fee's to any country or region. Customs and Import fee's will be solely handled by the purchaser, Nightlifesuppliesusa.com is not liable or responsible for any customs fee's out of the country and should the customer refuse to fulfill the customs payments, or import fee's requested by any government entity and payment not made, the package will be re-routed and returned to the nearest distribution center and all shipping costs will be deducted from the invoice before a refund is issued.

The written order, invoice from Nightlife Supplies USA DBA and these terms and provisions constitute the entire agreement of the parties and shall not be modified except by written agreement signed by both parties. No verbal agreements are recognized or enforceable. The order is a binding contract under Florida Law, which shall be governed by the State of Florida. By submitting this order, the purchaser irrevocably consents that the State of Florida shall have sole and exclusive jurisdiction over the purchaser and any dispute or cause of action arising under this contract.

The purchaser acknowledges that fireworks, equipment(special effects, lights, trusses), or miscellaneous products are not sold on consignment or approval and are not returnable. Payment in full is due upon delivery of the product to the purchaser. We will substitute items when necessary. The purchaser must inspect the product upon receipt and all claims for discrepancies, shortages, and/or damages must be made in writing within three (3) calendar days of the receipt of the order or shall be deemed as waived by the purchaser.
The purchaser is solely responsible for posting and compliance with all local, state, and federal laws. Nightlife Supplies USA DBA does not assume responsibility. Nightlife Supplies USA DBA is not responsible for injury, damage, or loss sustained in shipping or due to the resale or use of fireworks. This transaction is a wholesale/retail commercial transaction between knowledgeable merchants/purchaser/buyer/ and consumers. This agreement is solely between vendor and purchaser and shall not constitute a joint venture or partnership under any circumstances. Nor shall the purchaser be the agent, dealer, or representative of Nightlife Supplies USA DBA. The purchaser is an independent merchants/purchaser/buyer/ and consumers and is buying the product for resale/or private use and is solely responsible for the safe handling and safe retail marketing of the products sold.

CUSTOM PRODUCTS: Custom products are NON REFUNDABLE so there for they cannot be returned. A return will be accepted only if there is a defect or if the product is not as described. A store credit will be issued or a new unit will be produced. If you receive a damaged product. The buyer MUST NOT assemble it, or use the product in any way. It must be put back in its original packaging to wait for the claims process to be completed or if there is an agreement made between the seller and buyer. If the buyer uses the product in anyway, shape or form, and does not put the product back in its original packaging, THE SALE IS FINAL. In this situation, the proper steps in the claims process have to be taken with the carrier at fault in order for the carrier to compensate the buyer and the seller for the damages. If an agreement is not reached between the carrier, buyer, and the seller. The seller reserves the right to replace the broken item or issue a store credit only, NO REFUNDS will be issued on custom products. If an order is canceled AFTER an email art approval confirmation to proceed with production is received by the customer/Buyer. A 20% CANCELLATION FEE WILL BE APPLIED. "ALL SALES ARE FINAL"

DAMAGED PRODUCTS: Nightlife Supplies USA uses FEDEX & USPS as their main carrier for all our shipments. We take every precaution in packaging to make sure that your product(s) arrive safe and on time with no damages. But since we cannot control what the carrier does once it leaves our warehouse. Nightlife Supplies USA insures ALL SHIPEMENTS incase you receive a damaged product. Once you receive your order, you have 72hours to inspect the product received and report it to Nightlife Supplies USA if there is an issue with its performance or you receive a broken product. Like that Nightlife Supplies USA can take the proper steps on your behalf to file a damaged claim with the carrier to get the product replaced. After 72hours, it is up to you the consumer to report the damage product to FEDEX or USPS. Some exceptions can be made depending on the circumstances.

All customers should phone and make arrangement ahead of time to pick up their orders. This will enable us to have most of the order ready when you arrive and prevent waiting. Please give us at least 48 hours advance notice unless it is crucial and we will make exceptions.

IMPORTANT NOTICE ON DAMAGED PRODUCTS: Customer is responsible to be at the shipping address location to receive the merchandise the first time it is attempted. If damages happens to a product due to multiple delivery attempts by the shipping carrier. Customer is fully responsible for those damages. A new unit will not be sent out or free repair will be offered. Customer is responsible to file a "damaged claim" with the carrier directly, Nightlife Supplies USA will assist in that process if needed. Nightlife Supplies USA will not be held responsible for any charges or damages after the first delivery attempt by the carrier.

CANCELLATIONS and or RETURNS:

You may return most new, unopened items within 2 calendar days of delivery for a full refund. We'll also pay the return shipping costs if the return is a result of our error, you received an incorrect product, or a defective product. If the customer wishes to cancel their order after the delivery because you no longer want the products. They will be responsible to return the items to receive a full refund. A 20 % restocking fee will be accessed. If they cannot return the item or items. the SALE IS FINAL.
You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

CANCELLATIONS: Due to the sensitivity of most of our products. If the customer wishes to cancel an order. They must return the item(s) in their original condition and original packaging to receive a full refund. The returned packages will be inspected before a refund is issued. Customer has 2 calendar days to decide if they wish to return the product if not ALL SALES ARE FINAL. Unless an agreement is made with the seller. Customer will be in charge of the return shipping cost of all products purchased. If customer returns a product used or damaged. They will be charged for the product or products. A 20% restocking fee will be accessed if the customer wants to return an item simply because they dont want it.
